Litigation for the Deprived
The Pravasi Legal Cell had filed a writ petitions before the Hon’ble High Court of Delhi on behalf of Noushaba Bano whose husband died in Saudi Arabia in March 2015. Naushaba Bano had received information from co-workers of her husband that he was brutally murdered by his sponsor in Saudi Arabia on requesting vacation for visiting home in India. The sponsor allegedly video graphed the murder and showed it to other workers threatening them with same fate on wanting to go back to India.
Medical records from Saudi Arabia showed hanging as the cause of death. That despite completion of more than nine months from the date of death, the mortal remains of the deceased had not been repatriated, the widow approached Delhi High Court and the Court directed Union of India to bring back the mortal remains within a month. Even after waiting for 3 months from the date of the said order, the dead body was not brought back, and then she filed a contempt petition before the Delhi High Court, and the Court started to monitor the issue and decided to list the matter on daily basis and directed Union of India to apprise about the daily progress. Finally the dead body was brought back to India on 29.04.2016.
The family again approached the Delhi High Court for a postmortem and the Delhi High Court directed AIIMS to conduct postmortem in its order dated 6.5.16. Report of the postmortem dated 19.5.16 by AIIMS ruled out hanging as the cause of death. Soon after the receipt of the postmortem report, the family sought intervention of the Union of India as it is an issue relating to the brutal death of an Indian citizen abroad. But no relief has come around till date, and the widow has approached the Delhi High Court again for justice. The HC has issued notice to the Ministry of External Affairs, Govt. of India directing it to file a status report on the issue.
Hon’ble Mr. Justice Ashutosh Kumar of High Court of Delhi appreciated the efforts of Pravasi Legal Cell in providing legal assistance to the poor and marginalized community and in ensuring justice for the poor widow.
